By accessing www.spliquor.ca or placing an order with us, you agree to these Terms of Service (“Terms”). The website is operated by 2137202 Alberta Ltd., operating as South Park Liquor (“South Park Liquor,” “we,” “us,” or “our”). These Terms govern your use of our website at www.spliquor.ca (the “Website”), your purchases, and any communications between you and South Park Liquor.

These Terms include our Privacy Policy, Shipping Policy and Return & Refund Policy. If you do not agree with these Terms, please do not use the Website.

1. Age Requirement

You must be of legal drinking age in your province or territory of residence to purchase alcohol from our Website. A valid government-issued photo ID and the signature of a sober adult of legal drinking age are required at delivery or in-store pickup.

Legal Drinking Age in Canada:
18 years old: Alberta, Manitoba, Quebec
19 years old: British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Ontario, Prince Edward Island, Saskatchewan, Yukon

We may refuse or cancel any order, and the courier or our staff may refuse delivery or pickup, if we cannot confirm that the recipient is of legal drinking age, or if the recipient appears intoxicated.

2. Your Responsibilities as a Buyer

By placing an order, you confirm that:

• You are of legal drinking age in your province or territory, and so is the person receiving the order.
• You are buying for your own personal use or as a gift, and not for resale or commercial use.
• Your purchase, including the quantity you order and the delivery address, complies with the laws of the province or territory where it will be delivered. You are responsible for knowing and following those laws, including any personal import limits.

We may refuse or cancel orders that appear to be fraudulent, placed by resellers, or not in line with these Terms or the law. If we cancel an order you have paid for, we will refund you in full.

3. Use of Our Website

License
We grant you a non-exclusive, non-transferable, revocable license to access and use the Website for lawful, personal purposes only, in accordance with these Terms.

Your Account
You are responsible for keeping your account login details secure and for activity on your account. Please tell us right away if you believe your account has been used without your permission.

Accurate Information
You agree to provide accurate, current and complete information when using the Website and placing orders. All information we collect is handled in accordance with our Privacy Policy.

Prohibited Activities
You agree not to interfere with or compromise the security, functionality or integrity of the Website. This includes unauthorized access, scraping or copying of website content, reverse engineering, introducing malicious code, or removing proprietary notices.

4. Orders

When you place an order, you are making an offer to purchase. You will receive an order confirmation by email with the details of your order; please keep it for your records. We may decline or cancel an order for any of the reasons in these Terms, including product unavailability, pricing errors or suspected fraud. If we do, we will let you know and refund any amount paid.

If you need to change or cancel an order, please email info@spliquor.ca with your order number as soon as possible. Orders can be changed or canceled before they ship.

5. Prices, Taxes and Payment

Prices
All prices are in Canadian dollars. Prices may change at any time, but the price charged is the price shown when you placed your order. Applicable taxes, bottle deposits and shipping are shown at checkout before you pay.

Pricing and Listing Errors
We work hard to keep prices and product information accurate. If a product is listed at an obviously incorrect price or with incorrect information, we may cancel the order and refund you in full, or contact you to offer the product at the correct price.

Payment Methods
We accept Visa, Mastercard, American Express, Discover, Diners Club, JCB, UnionPay and Shop Pay. Apple Pay and Google Pay are also available on supported devices. Payments are processed securely by our payment provider, and we do not store full card numbers. By placing an order, you authorize us to charge your selected payment method for the total amount due.

Bottle Deposits
In accordance with Alberta’s Beverage Container Recycling Program, bottle deposits apply to recyclable containers where required by law: $0.10 for containers up to 1 litre and $0.25 for containers over 1 litre.

6. Savings, Sale Items and Discount Codes

• Automatic Cart Savings: our automatic savings (3% off orders of $249 or more and 5% off orders of $499 or more) apply to all products, including sale items.
• Rewards coupons from our rewards program can be combined with other discount codes.
• Other discount codes are subject to the terms of each promotion and may exclude sale items or certain products. Codes are valid for online purchases only, cannot be used in-store, and cannot be applied to orders placed before the code was active.
• Sale items are limited in quantity and sold on a first-come, first-served basis. If an item is marked with a purchase limit (for example, “Limit 1 Per Person”), orders over the limit may be adjusted or canceled and refunded.
• Our rewards program is also governed by the terms shown in the rewards panel on our Website.

7. Product Availability, Images and Vintages

All purchases are subject to product availability. Quantities may be limited, and items may become unavailable without notice. If an item you ordered is unavailable, we will contact you and refund that item or offer an alternative.

Product and bottle images are for illustration only and may differ from the product you receive in vintage, bottle shape or label design. Vintages are not listed in our product titles because they change regularly. Because of the Alberta liquor distribution system, we cannot always guarantee a specific vintage. If you need a specific vintage, please contact us at info@spliquor.ca before ordering. If a vintage you requested is unavailable, we will contact you to either accept the available vintage or remove the product from your order.

8. Product Information and Responsible Use

Product descriptions, tasting notes, alcohol content and other details are provided for general information and are based on information from producers and suppliers. Recipes and products may change. Always read the label before consuming, especially if you have allergies or sensitivities; for example, many wines contain sulphites.

Please enjoy our products responsibly. Do not drink and drive, and do not provide alcohol to anyone under the legal drinking age. If you are pregnant, taking medication or have a medical condition, ask a health professional before consuming alcohol.

9. Shipping, Returns and Refunds

Shipping and delivery are governed by our Shipping Policy. Returns and refunds are governed by our Return & Refund Policy.

10. Reviews and Feedback

If you submit a product review, comment, suggestion or other content (“Feedback”), you give us a non-exclusive, royalty-free, perpetual license to use, reproduce, edit and display it in connection with our business, including on our Website and in marketing. You confirm that your Feedback is your own, is honest, and does not violate any law or anyone else’s rights. We may remove Feedback that is unlawful, offensive or misleading.

11. Intellectual Property

The Website and its content, including text, graphics, logos, images and design, belong to South Park Liquor or its licensors. You may not copy, reproduce or use them for commercial purposes without our written permission. Product names and brands belong to their respective owners.

12. Third-Party Services and Links

Our Website may include links to, or features provided by, third parties (for example, package protection, payment providers and couriers). We do not control these third parties and are not responsible for their content, policies or practices. Your use of their services may be subject to their own terms.

Our store is hosted on Shopify. Your purchases are made directly with South Park Liquor, and Shopify is not responsible for the sale of products to you.

13. Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the Website is provided “as is” and “as available.” We do not guarantee that it will always be available, uninterrupted or error-free.

To the fullest extent permitted by law, South Park Liquor is not liable for indirect, incidental, special or consequential damages, including loss of data or profits, arising from your use of the Website or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded by law, including your rights under Alberta’s Consumer Protection Act or the consumer protection laws of your province or territory.

14. Indemnification

You agree to indemnify South Park Liquor against claims, damages and costs, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Website or our products, including any resale or unlawful use.

15. Changes and Termination

We may update these Terms or modify, suspend or discontinue any part of the Website at any time. Updated Terms will be posted on this page with a new “Last Updated” date and apply to orders placed after they are posted. We may suspend or end your access to the Website if you violate these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any disputes will be resolved in the courts of Alberta, in the judicial district of Edmonton, except where the consumer protection laws of your province or territory give you the right to bring a claim where you live.

17. General

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect. Our failure to enforce any part of these Terms is not a waiver of our rights. These Terms, together with the policies referred to above, are the entire agreement between you and South Park Liquor regarding your use of the Website and your purchases.
